Rahul Gandhi’s ‘Rafale scam’: A repeat of the fake ‘coffin scam’ that Congress used to hound Vajpayee and George Fernandes

The demise of George Fernandes today brings back the memory of how he, and the NDA government he was part of, was hounded by Congress using a fake scam. During the Kargil war, the government of India had purchased 500 coffins from a company in the USA for transporting the mortal remains of the soldiers perished in action. The coffins cost $2,500 per unit. The opposition parties, led by Congress, had alleged that there was a huge scam in the purchase as the price paid by India was too high. It was alleged that the price was thirteen times the original price, and India had lost $1,87,000 in the ‘scam’. George Fernandes was defence minister in the Atal Bihari Vajpayee government at that time, two persons known for their personal integrity.

This ‘coffin scam’ has lots of similarities with the ongoing ‘Rafale scam’ that Rahul Gandhi is trying to establish as a real scam. Although the Congress party badly wants the ‘Rafale scam’ to become the Bofors scam for BJP, it is actually a repeat of ‘Coffin scam’. Both so‑called scams are based on fictitious allegations, made up numbers, and complete disregard for facts. In both the cases, opposition parties ignore information provided by the Indian government and respective foreign governments.

During the Kargil war, the Indian government had decided to purchase high-quality Aluminium coffins for the armed forces. The Indian armed forces had seen such coffins used by American forces in peacekeeping missions abroad and had sought the same for Indian Army. The coffins are actually Aluminium caskets, which are reusable, unlike the single-use wooden coffins. They are called transfer cases, used by the military to transport bodies from harsh conditions, and they can’t be compared with ordinary coffins used for funerals. Just like at present Rahul Gandhi is comparing the prices of bare aircraft and fully loaded Rafale, that time also prices of Aluminium caskets were compared with ordinary coffins to invent a scam.

Both the Indian government and French government has assured that Dassault is free to select its offset partners, but Rahul Gandhi keeps alleging that Dassault was forced to select Reliance as offset partner, and Modi has given ₹30,000 crore to Anil Ambani through the Rafale deal. Similarly, the government of the United States of America had confirmed in writing that the caskets cost $2,768 each, therefore, the price India was paying was not more than then the actual price. In fact, India was able to secure a discount on the custom-made coffins.

Adding more fuel to the so-called coffin scam, a CAG report had said that actual price of the coffins is $172 only. This figure had no basis as there was no evidence of anyone buying or selling Aluminium caskets at such a low price. Even single-use wooden coffins cost more than that, therefore it was impossible that Aluminium caskets will be available at such low price, given that these items are custom made based on orders mainly for military, and not mass produced for general use. Later it was found that $172 could be rent for the reusable caskets, and not price of the same. Just like Rahul Gandhi has used the entire offset amount in Rafale deal, the bulk of which go to PSUs, a benefit given to Reliance, that time also a rental price was used as the purchase price to invent a scam.

Just like during that time the opposition had ignored that fact that India was buying a US military standard product which can’t be compared with products made for general public, this time also the Congress party is ignoring that fact that Dassault has made several India specific modifications to the Rafale jet, and it includes several advanced weapons and other systems.

The main corruption involved in any defence deal is a bribe paid by the supplier to win the deal. But in the current allegation about the Rafale deal, nobody has alleged any payment of a bribe. The aircraft was selected during the UPA government after an extensive bidding process, and the current deal is with the French government, therefore there is no bribe angle. Similarly, there were no allegations of bribes being paid in the coffin deal, it was just a wild accusation of excess payment.

The most important fact is, ultimately the court had found that there was no evidence of any scam in the coffin deal during the ABV government. In 2013, the court had discharged three army officials named in the case for lack evidence. In 2015, the Supreme Court had given a clean chit to the NDA government over the case, as the allegations were not proved during the CBI probe. Similarly, several petitions have been filed in the Supreme Court alleging a scam in the Rafale deal, but the apex court has refused to order a probe in the deal after studying all the documents related to the purchase of 36 fighter jets from France.

Even after courts had found no evidence of corruption in the coffin deal, Congress continued to make the allegations, just like Rahul Gandhi keeps repeating his lies about the Rafale deal even after Supreme Court has found no wrongdoing.

Although Coffin scam was not real, Congress was able to cast a shadow of doubt over the integrity of Vajpayee government with the help of a media that refuses to fact check allegations made by the party. Sonia Gandhi had called late Atal Bihari Vajpayee a ‘Kafan Chor’. And the exact thing is being repeated now, with no media dares to question Rahul Gandhi on his ₹30,000 crore allegations, and Rahul Gandhi saying “Chowkidar Chor Hai”, referring to Narendra Modi.

A personal loss for me: Says Bihar CM Nitish Kumar on demise of George Fernandes, announces 2-day state mourning

Bihar Government has announced a state mourning for two days and also has cancelled all official functions, following the demise of former Union Minister and  Socialist leader Geroge Fernandes. George Fernandes had formed Samta Party in 1994 along with the now Bihar Chief Minister Nitish Kumar, who had parted ways with Janta party. The Janata Dal had formed the government at the centre after the fall of the Rajiv Gandhi-led government due to the Bofors Scandal.


Speaking about the demise of the Socialist leader, CM Nitish Kumar labelled the death as a personal loss.

“A new party was formed under his leadership and guidance. His guidance has been crucial in whatever I have learnt and whatever I strive to do for the people.” CM Nitish Kumar said. He added that everyone is destined to go one day, and since the leader was suffering from illness for a long time, death has come as a kind deliverance for him. Nevertheless, he said, this is a sad situation. Fernandes was suffering from Alzheimer’s disease and had recently even contacted swine flu.


He was the convenor of National Democratic Alliance, headed by Bharatiya Janta Party during Atal Bihari Vajpayee tenure. His Samta Party had merged with JD(U) in 2003.

Bihar’s Deputy Chief Minister Sushil Kumar Modi also expressed grief over the demise of Fernandes. He cancelled all his public meeting, slated for today. Union Minister Ram Vilas Paswan said that Fernandes life was full of inspiration and that it will continue to guide our youth. Vijay Kumar Choudhary, Head of Bihar’s legislative, said that Fernandes loss is irreparable one.

Indira Gandhi declared a state of Emergency on 25th June 1975, suspending all fundamental rights. Fernandes was amongst those who opposed the blatant misuse of power and was hounded for the same. He later went underground to escape arrest and prosecution. His brother, Lawrence Fernandes was arrested and tortured by Police to find out George’s whereabouts.

Fernandes became Union Minister of Industries in Morjai Desai’s government in 1977. He was also defence minister for India, during the Kargil War and 1998 Pokhran Tests.

Former Congress leader Shankersinh Vaghela joins Sharad Pawar’s Nationalist Congress Party

Veteran Congress leader Shankersinh Vaghela, who left the party in 2017, has now joined the Nationalist Congress Party in the presence of party’s Supremo Sharad Pawar and its leader Praful Patel.


Vaghela was the senior leader of BJP and is a prominent OBC face from Gujarat. BJP had won a majority under his leadership in 1996, but the party had decided to make Keshubhai Patel as CM. This had promoted Vaghela to led a rebellion against party along with his 47 MLAs. Despite several rounds of negotiations, he resigned from BJP after he lost his Lok Sabha seat of Godhara in May 1996.

He later floated his own party named Rashtriya Janata Party and formed the government in Gujarat with help of Indian National Congress in 1996. He later joined INC and was made Union Minister in May 2004, after he won Lok Sabha elections in 1999 and 2004 from Kapadvanj. He was also selected as leader of the opposition for Gujarat assembly and also served as Gujarat Pradesh Congress Committee head. 

However, in 2017 things changed on the eve of Gujarat’s Rajya Sabha elections. Three seats of Rajya Sabha from Gujrat were going to the election, for which four candidates had filed nomination. From BJP, President Amit Shah, Union Minister Smriti Irani. From Congress, Ahmed Patel contested.

On 21st July 2017, on the occasion of Vaghela’s birth anniversary, he resigned from Congress claiming that he was sacked from the party. Following which, 3 Congress MLAs resigned from the party, and joined BJP. One of the MLAs to quit was Balwantsinh Rajput, then Chief Whip of Congress in Assembly and a close relative of Vaghela. Rajput was then made the third candidate for Rajya Sabha, along with Amit Shah and Smriti Irani. Very next day, 3 more Congress MLAs quit joining the BJP, bringing down the strength to 51 MLAs. Not only this, Vaghela himself and his son also voted against Congress. This had made chances of Ahmed Patel getting elected to Rajya Sabha, tougher.

Despite all this Ahmed Patel had won the elections. Balwathsinh, however, filed an election plea in High Court alleging Ahmed Patel of indulging in malpractices during elections.

After resigning from Congress, Vaghela founded a new party Jan Vikalp Morcha ahead of 2017 Gujarat Legislative Assembly election. As Election Commission did not approve his application for the new party, he fought under the banner of Jaipur-based  All India Hindustan Congress Party. However, his party lost deposits on all seats they contested.

Currently, NCP has one MLA in Gujarat and is electorally not very active in the state. Vaghela’s entry into NCP can lead to triangular contest in the state if Congress and NCP fail to reach a deal before the 2019 General elections. Currently, BJP has all the 26 Lok Sabha seats in the state.

George Fernandes: The Socialist who refused to make the Faustian bargain with Gandhis

“Mujhe lagta hai ki kisi ghulam ki aulad ne ye kaam kiya hai. koi sabhya aadmi ye kaam katai nahi karta. kis aadhar pe laga di ye? ye kya desh kya in logo ne khareed liya hai kya? Nehru khandan.. kya khandan hai, lootpaat wala”. Peeved at Sonia Gandhi’s picture appearing at Constitution Club in Delhi, George Fernandes remarked so and got the picture removed. George Fernandes was not one to mince words when in active politics. George Fernandes has gone silent today.

Born in Mangaluru in 1930, Fernandes won Lok Sabha elections from Bombay (now Mumbai) South seat in 1967, Muzaffarpur seat in 1977, 1980, 1989, 1991, and 2004, and Nalanda seat in 1996, 1998, and 1999. Ironically, the one election he lost in 1984 was from Bangalore North seat in his home state. Off his wins, the one in 1977 stood out.

Fernandes, who had no connection with Muzaffarpur until then, contested this election post-Emergency election, while he was still lodged in prison. He did not visit his constituency even once. He polled 77.3% of the total votes, with his Congress rival Nitishwar Prasad Singh getting just 12.2%. Muzaffarpur would not let down the poster child of the resistance against Indira Gandhi’s Emergency, even if Muzaffarpur did not know him personally.

Fernandes’ 1976 picture, his left hand raised, fist marking his resolve and the long iron chain depicting his captivity, is one of the most iconic and identifiable pictures in Indian politics. He was arrested in the Baroda Dynamite Case during the Emergency. The Central Bureau of Investigation (CBI) had charged Fernandes with a conspiracy to overthrow the Indian government and tried him in Delhi rather than in Gujarat, one of the few states in the initial days of Emergency not to have a Congress government. Fernandes and his alleged co-conspirators were charged for plotting blasts in government offices and at Indira Gandhi’s Varanasi rally venue to protest the imposition of Emergency. He was still under trial and lodged in the Tihar jail when he won the Muzaffarpur seat. The case was withdrawn by the Janata government in 1977.

George Fernandes was a principled socialist leader who became active in Mumbai local politics in the 1960s. Influenced by Rammanohar Lohia, he built his career as a trade unionist. In the tumultuous years when the nature of the Mumbai industry was changing, and when the industry-labour relations were at their ebb, Fernandes emerged as the voice of the unions. He would routinely call for strikes in Mumbai in the 1960s and was dubbed as the man who could stop Mumbai.

Although his influence in the city waned in the 1970s as the industry diversified and the underworld influence increased, his most famous strike action is from 1974. As the President of the All India Railwaymen’s Federation, he called for a nationwide strike by motormen in the month of May that year. His strike call was supported by other Railway employees as well as transport operators like taxi unions in Mumbai. The city of Mumbai as also most parts of the Railway-dependent country came to a grinding halt. Thousands of arrests followed during the 19-day strike, as then Prime Minister Indira Gandhi was spooked by this subordination – this event is said to have influenced her decision to impose Emergency in 1975 among other things.

His stints as Union Minister were eventful and controversial.

In the Janata government of 1977, he was appointed the Minister of Industries. He was against globalization and sought to strictly impose various rules which discouraged foreign capital investment in India. Multinationals like IBM and Coca-Cola quit India during his term as the Janata government tried to heavy-handedly unwind everything they disliked too early in the term.

His opposition to then Janata Party, now Bharatiya Janata Party (BJP), ministers and legislators keeping active Rashtriya Swayamsevak Sangh (RSS) connections while being part of a common agenda driven government, was one of the reasons why the Morarji Desai government fell in 1979. His political journey which started with the Samyukt Socialist Party in 1967, moved to Bharatiya Lok Dal in 1977, Janata Party (Secular) in 1980, led him to Janata Dal in the late 1980s. As the Railways Minister in the VP Singh Cabinet, he started the process of developing what is today known as Konkan Railways.

In 1994, Fernandes formed the Samata Party, which went on to ally with the BJP, while his erstwhile Janata Party (Secular) and Janata Dal colleagues distanced themselves from the emerging national party, in a reiteration of the 1979 stand. Through Samata Party’s association with the BJP, Fernandes became the Defence Minister in Atal Bihari Vajpayee government.

As the Defence Minister, Fernandes dealt with the Kargil War of 1999, which came with its own trials and tribulations. Navigating through a difficult period, Fernandes then oversaw the defence budget increase in the Vajpayee era and building stronger bases in Siachen. He made 18 visits to Siachen, starting the process of Indian Defence Ministers making regular visits to the icy heights, which continues till date.

The Kargil War also brought Fernandes the infamy of Operation West End in 2001. The employees of Tehelka magazine, then riding the rising graph of Indian media modernization, conducted a sting operation attempting to bribe defence officials. They posed as arms dealers and bribed several officials and politicians luring them into murky dealings, using a fictitious London-based company West End as the front. Fernandes resigned in the wake of this scandal but was later reinstated as the Defence Minister.

However soon after in 2002, Fernandes was accused of being involved in the infamous Coffin Scam. The alleged scam was about overpaying for coffins bought from the United States to carry the mortal remains of the Kargil War soldiers. The alleged scam made headlines just before the 2004 election. However, the CBI could not furnish any evidence in its 2009 charge-sheet against Fernandes. In fact, in October 2015, the Supreme Court discharged all the accused in this alleged scam as being not guilty.

However, the allegations resonated loud in the state elections 2002 through 2004 and in the run-up to the 2004 General Elections. ‘Coffin chor gaddi chhodo’ – Congress cried in Parliament, leading to routine House disruptions. Fernandes did not have the benefit of agile media or social media to his rescue then. The Vajpayee government paid the price having been considered tainted. The eerie similarities between this allegation and what’s playing out now with the Rafale deal cannot be a coincidence.

Fernandes merged his Samata Party with the Janata Dal (United) (JDU), which was one of the factions to come out of the Janata Dal splits in the late 1990s. The JDU was his last political home – he won the Nalanda seat for the JDU in 2004, resigning in 2006, when he went off the active political scene.

Fernandes frequently changed his party allegiances, alliances, and Lok Sabha seats. There was however one thing which remained permanent to his politics – the opposition to the Congress and to the Nehru-Gandhi family. He was a strident critic of Indira Gandhi and all her Congress successors. Unlike his other socialist fellow-travellers, he never had a truck with Congress. He paid the price for this intransigence, getting jailed without being charge-sheeted, being tortured in the Tihar jail, and then being named in scams which were never proven.

His politics was not palatable to everyone and his views evolved only in the last decade of his public life when he supported the Pokhran nuclear tests and steadfastly remained a Vajpayee backer in a reformist, pro-market government. But he remained principled and true to his convictions.

George Fernandes, a guiding light of the anti-Congress political spectrum, dies a clean man, just like he conducted his politics.

Before Akhilesh Yadav questions others, he must remember his own legacy of bad governance

Lok Sabha elections are around the corner and the process of converting baseless issues into controversies has already begun. While Uttar Pradesh has always been the centre point of politics, these days it has become the centre of allegations and counter allegations. Recently, former Uttar Pradesh Chief Minister Akhilesh Yadav had cried crocodile tears over what Yogi Adityanath said on Republic Day.

Addressing a public gathering on 26th January, Uttar Pradesh Chief Minister Yogi Adityanath had said that the court should give the Ram Mandir verdict sooner than later. Yogi Adityanath had said that if the court could not do so, he should be allowed to handle the matter and Yogi Sarkar would bring a solution to it within 24 hours.

Reacting to it, Akhilesh Yadav said, “Our country is celebrating the 70th Republic Day. If a chief minister is saying such a thing, then just think what kind of chief minister he must be.” He further told the CM that the people have given him 90 days to bring a solution to save the crops from bulls. He said that saving the farmers should be a priority.

A chief minister replying to questions on the promises he made may be wrong in the eyes of the former chief minister as his own experience has been different in the same. Akhilesh Yadav seems to have forgotten that there is still time left for Yogi Adityanath’s tenure as chief minister to come to an end. And if Akhilesh were to be questioned, he has no idea about the questions that could be asked to him.

If you remember back in 2013, Akhilesh was more keen to talk to Katrina Kaif instead of talking to the people who elected him. During his tenure as the chief minister, Akhilesh Yadav rubbed shoulders with a lot of Bollywood celebs. In 2013 during the inauguration of Hockey India League, Yadav was busy listening to what Katrina Kaif had to say and was politely seen nodding to a lot of political questions Katrina had for him. Perhaps even back then, he was busy thinking about the farmers and the problems faced by them. Or Akhilesh Yadav found answers to the farmers’ problems in the precious moments spent with Katrina Kaif.

Actually, Akhilesh Yadav may be right. The work he had done for the public as chief minister was completely different than the work being done by Yogi Adityanath. While Yogi Adityanath seems to be working for the people, back in 2016, when Akhilesh was the chief minister, thousands of litres of water was used to create a helipad for him as the state faced a drought-like situation.

Akhilesh Yadav was so concerned about the drought and the plight of people that he was oblivious to the water wasted on creating the helipad. When the same Akhilesh gives lessons to Yogi Adityanath on how to tackle the problems faced by farmers, it is a little amusing, to say the least.

Akhilesh was so busy during his tenure as the chief minister that he did not think twice before trashing the official government accommodation before vacating it. It is a different matter that the man who didn’t think twice before ruining the government accommodation has spent crores on construction and decoration of his own new home.

Akhilesh Yadav, who targets the BJP by firing the gun at them from the shoulders of the farmers, conveniently forgets his own time as chief minister of the state. If only he had followed the advice he is giving to Yogi Adityanath, he would not have had to face such an embarrassing defeat in 2017. As compared to other states, Uttar Pradesh farmers ranked way high in suicides committed. This not only raises questions on his manner of working but also makes one wonder about his intentions, considering the Lok Sabha elections are approaching.

If Akhilesh boasts of not getting into coalition in 2016 could not stop himself from getting close up and personal with Congress in 2017. And somehow, the same Akhilesh has forgotten decades-old enmity and joined hands with Bahujan Samaj Party, putting up the aunt-nephew drama.

Akhilesh Yadav, before you question others, why do you forget your own time as the chief minister?

6 key points that PM Modi discussed with students during the ‘Pariksha pe Charcha’ event

Prime Minister Modi today addressed around 2,000 students and teachers from India and abroad, at the ‘Pariksha pe Charcha‘ event, weeks before the board examinations. He was answering varied question regarding stress, time-management and the anxiety of parents during the exam time.

PM Modi started the address with condolences to Socialist Leader George Fernandes who passed away recently, due to prolonged illness. He said Fernandes was a dynamic leader, who fought vehemently against the Emergency period during the Former Prime Minister Indira Gandhi’s era.


PM Modi said that the event has not been organized with the intent to give lessons or sermons to students. He said that he is there, just to become like his viewers and live like them.

Expectations of Parents about their children

The first set of question came to PM Modi about the stress of students and parents during exam time. A teacher from Kendriya Vidyalaya, Kolkata asked about what to tell parents who treat exam as the foundation of a life of their children. A UPSC Civil Service exam aspirant from Kerala asked how to deal with the pressure of expectations and also asked PM Modi that how does he deal with the expectations of our nation.

PM Modi said that students should ask themselves whether the exams are for class 10 or 12 only, or are exams for your life. He asked parents not to impose their unfulfilled dreams upon their children. He said the expectations adds more burden to already burdened children. He said, instead parents should encourage their children to face failures like a mother teaches her toddler to stand up once he falls while walking.


On the other hand, he also said that expectations steer students from disparity and unhappiness. He also appealed students to be attentive to their guardian’s views, and also apply that to their everyday life.

A parent asks PM Modi about the menace of technology

A parent from New Delhi asked PM Modi about the ill-usage of technology, and about its negative impact on his son’s studies. She said that her son, used to be good at studies, but now stays distracted due to games. PM Modi jokingly asked whether her son was addicted to PUBG (A popular multiplayer online game).

PM Modi explained about both the facets of technology. He said that technology is both a problem and a solution. He said that nowadays every child has a mobile phone, so it becomes important to take care of how it is used.


PM Modi said that Playstations(popular gaming console) are good, but students should not give up on playgrounds.

A student from Tamil Nadu asked PM Modi that how does he manage to work for 17 hours and what is key to his energy.

PM Modi, answering to question, said that he thinks that 125 crore people of the country are his family members and tiredness is not an option when serving them. He labelled time-management as one of the most important aspects of exam preparations.

He asked students to analyze how they spent their whole week on what tasks. This way, PM Modi said, that students will be able to ascertain that what percentage of time they utilised and what time they wasted.

A student asks, how to make studies more fun?

A student from Pathankot and a student from Kathmandu asked PM Modi that how exam help in personality development and how to make it more fun.


PM Modi said that students should take as an opportunity and not as a mere exam. He said that students should look for knowledge and marks will eventually follow the aspirant. He asked everyone to enjoy exams like a festival, this way it will lessen their stress and help perform better.

“It is common thinking that Science and math are more important than other studies. How to change that?” Student asks PM Modi

A student from Aligarh Muslim University and a student from Benaras Hindu University asked PM Modi about the subject choices, and how students are forced to go for science and math than arts and commerce.

PM Modi said Math and Science are subjects of paramount importance but parents should also view that in what stream his child is interested. He said that studies should only be driven by passion.


He said that choosing of the stream should be based on conviction rather than on pressure. He urged students to take the cue from teachers and parents regarding their career.


He said that teachers and students should never compare one student with another. He also appealed to students to compete within themselves rather than with others.

PM Modi talks about depression, encouragement for exam and others

A student from Moscow appreciated PM Modi for his efforts undertaken for the students since his last Townhall on exams. A student from Kuwait gave inputs to improve the education system of the country.

PM Modi said that learning should not be reduced to exams only. He said that our education system needs to include the challenges faced by us as well. Depression, according to PM Modi, is a  big issue and needs to be dealt with talking about it and realizing its impact.


He also emphasised on the importance of counselling in one’s life.

PM Modi’s interaction with students on tackling exam related stress is hailed as a one of its kind initiatives. The PM had also launched a book last year titled ‘Exam Warriors’ that discussed study related stress and encouraged students to ignore stress while striving for excellence.

A sordid tale of Emergency: The illegal detention and torture of George Fernandes’ brother

The former Defense Minister of India, George Fernandes, passed away earlier in the day. A lifelong socialist, he emerged as one of India’s tallest leaders through his resolute opposition to Indira Gandhi’s Emergency and stellar leadership afterwards.

Tributes started flowing once the news broke out and the Congress party was quick to offer its condolences as well.


It appears that the Congress party has forgotten how it treated the great man when he was alive. In this article, we shall explore how Fernandes’ brother, Lawrence Fernandes, was wrongfully arrested and tortured by the Police during the Emergency as described in the Shah Commission report.

Lawrence complained to the Commission that he was taken from his house on the 1st of May, 1976 by two policemen, Inspector Narayan Rao and one other officer of the Corps of Detectives of the Karnataka Police, Bangalore. He was then interrogated about the whereabouts of his brother and when he failed to produce the answers that satisfied the Police’s curiosity, he was “brutally assaulted” by a group of 8 to 10 policemen which caused immense injuries to his body.

Lawrence’s account was corroborated by a report lodged by his father, J.J. Fernandes with the Police Control room on the 2nd of May, 1976. The “Crime and Occurrence Sheet” dated May 3, 1976, also mentions the father’s account that his son was missing since the 1st. The Commission report states, “Shri Jacob Fernandes has stated that he had in his complaint to the police control room informed that the police had taken away his son from his house on the night of May 1, 1976, and the enquiries conducted by him with the various City Police stations had yielded no results. The police control room record relating to the “Crime and Occurrence Sheet” dated May 3, 1976, mentions only the complaint made by Shri Jacob Fernandes that the complainant’s son, Shri J.J. Fernandes was missing.” The Commission notes that J.J. Fernandes in the police record actually stands for Lawrence Fernandes.

Lawrence’s mother also made submissions of petitions and telegrams dated 5th and 6th of May, 1976 addressed to various authorities complaining about her missing son. The copies were sent to the Chief Minister of Karnataka, the Prime Minister, the President and the Chief Justice of India.

Apart from statements by his parents, various other people, including a Times of India correspondent, corroborated Lawrence’s account of the events that transpired.

The Commission also mentions Lawrence’s allegation that on the 3rd of May, his condition had worsened considerably due to torture by the Police and a physician was called upon to check on him. Dr Rajagopal, who was examined by the Commission, stated that he did examine Lawrence on the said date and was advised by the constables not to ask any questions but only to examine the patient. He further stated that he had advised to have the patient “hospitalized and X-rayed”. According to him, “injuries must have been due to some external violence or some such thing” and that he suspected fracture in the left foot and thus, recommended an X-ray. He said that he had seen the same patient at the K.C. General Hospital on the 13th of May but was not aware of his identity until he saw news of Lawrence’s detention.

The Commission also noted that Inspector Parameshwarappa of the Malleshwar Police had lied outright during his deposition to the Commission to “save himself and his colleagues from the probable consequences of the illegal police detention and torture of Shri Lawrence.” The Commission also concluded that it was “established beyond doubt” that Lawrence was held in illegal custody by the Police.

The official police record showed that Lawrence was arrested on the 10th of May, 1976 in Davangere and was later produced before a local court. The Commission report states that the official record “bears a clear impress of fabrication and untruth.” He was arrested in connection with explosions on railway tracks by unknown people, however, his complicity had not been established in any of the case files pertaining to the explosions.

The circumstances of his arrest were described as ‘incredible’ by the Commission. The Commission noted that Lawrence had no money with him at the time of arrest, no bus ticket was recovered from him which would corroborate the Police’s claim that he was travelling to Hubli from the Davangere Bus Stand. Lawrence did not have any spare clothes with him either and neither did he have the bare necessities of daily life. He apparently did not have any money either to procure them.

In conclusion, the Commission observes that the case “highlights not merely the illegal detention and torture of an individual by the police, but the subversion of an entire legal system including the Judicial process by senior and responsible Government officers.” It also concluded that some of these officials had colluded with the police to ensure that the matter is not revealed to the public.

The report states further, “They (the police) resorted to illegal detention and torture, and to cover up a series of illegal and indefensible acts, some of them fabricated public records, gave false testimony and otherwise acted in a manner unbecoming of the high and responsible offices they held.”

Lawrence Fernandes was treated in the most despicable of ways by the Police merely because his was known to be a vocal critic of the Emergency. The CBI had charged George Fernandes and others of smuggling dynamite and blowing up government establishments as well. They were also charged with waging a war against the state to overthrow the government. They were arrested in June 1976 and kept in Tihar jail, Delhi.

In the heart-rending letter to the President dated May 24, 1976, by Alice Fernandes, mother to Lawrence and George, reveals a mother’s helplessness and sorrow and misery when her innocent son is suffering unimaginable torture in prison. After narrating the brutal torture that her son had to endure, she appeals, “I urge upon you in the name of all that is good in the civilised conduct of human beings and their governments, and in the name of justice, to order a thorough judicial enquiry into this barbaric torture, and take suitable action against concerned authorities. I also urge that he should be transferred to a good hospital, and specialist medical and psychiatric treatment be given to him, and daily visits to him be the family allowed so that he may regain his mental and physical health and become a human being …”

Under such circumstances, it appears to be in bitter taste that the Congress party is offering condolences to his family now that George Fernandes has passed away without offering an apology for the immense trauma that they had to endure during the Emergency due to mere politics.

AAP MLAs refuse to furnish details of their assets to Lokayukta, ask to recall the notices served to them

The Lokayukta and the Delhi assembly have been in loggerheads over notices served to the AAP MLAs over the declaration of their assets. On Monday, almost 50 Aam Aadmi Party (AAP) MLAs in Delhi, refused to furnish details of their assets and liabilities as directed by Delhi Lokayukta Reva Khetarpal. The MLAs have filed affidavits stating that demanding such declarations are not within the Lokayukta’s jurisdiction as there is no such law or legal provisions that prescribe the same.

While the Delhi social welfare minister Rajendra Pal Gautam and transport minister Kailash Gahlot are amongst those who have replied to the notice, AAP supremo and Delhi CM, Arvind Kejriwal and the Deputy CM, Manish Sisodia, who have also been served the notice by the Lokayukta’s office, are yet to respond.

However, three MLAs including BJP’s Vijender Gupta and Manjinder Singh Sirsa and rebel AAP legislator Kapil Mishra furnished details of assets and liabilities to the Lokayukta.

The remaining MLAs have been given time till February 27 to submit their replies.

While the AAP spokesperson, Saurabh Bhardwaj asserted that “there is no law that MLAs need to file details of their assets and liabilities to the Lokayukta”, Delhi Assembly Speaker Ram Niwas Goel had last week written to Justice (retd) Lokayukta Reva Khetrapal, requesting her to recall the notices served to the AAP MLAs, saying the allegations are “baseless and politically motivated”.

He today, urged her to move the court against BJP member Vivek Garg, who has filed a complaint with the authorities over the alleged non-declaration of assets and liabilities in the House by AAP MLAs.

Based on a complaint by an advocate and RTI activist Vivek Garg, Lokyukta Reva Khetrapal had earlier this month issued notices to Delhi MLAs seeking replies regarding the submission of details of their assets and liabilities for the last three financial years.

Garg had alleged that “AAP MLAs had not filed details of their assets from 2015 to 2018 and were concealing them in a conspiracy to obtain wrongful gains”.

The AAP MLAs in their replies, however, stated that the complaint filed by advocate Vivek Garg, which prompted the notice “is devoid of any merit and the same be dismissed with exemplary cost”. They furthered that under Section 9(2) of the Lokayukta Act, 1995, the petitioner should be penalised and sentenced to three years of rigorous imprisonment for false and baseless complaints.

Earlier this month the Lokayukta’s request to be exempted from the installation of GPS on official cars had also been turned down by the Delhi Government.

Goodbye, George Fernandes

You can feel that an era is coming to an end. The big names of the Vajpayee era are leaving us, one by one. Dr Kalam is no more. Atalji is no more. Madan Lal Khurana is no more. And now George Fernandes passes away.

Now, I am no socialist, but yes I am capable of looking beyond that to appreciate a man with sincerely held beliefs. And a working moral compass.

George Fernandes raising his shackled hand at the time of the Emergency. A show of defiance against a real dictator. At a time when our compromised liberal media is falling over itself to celebrate someone because she “looks like Indira”, this picture should give pause to the masses. A moment to reflect what Indira Gandhi really stood for.

I wasn’t born at the time the Emergency happened. For kids of my generation, this was the image of George Fernandes that got stuck in our heads.

I was a schoolboy at the time. I did not understand very much. But perhaps it was this simplicity that gave me clarity. I had not studied intersectional woke feminist theory at JNU, but I did understand the rules of the playground. Which was that the weak would get beaten. And studying the history of India in the school curriculum, even the sanitized version they gave us, could not hide the fact that our side had been beaten over and over again.

Subdued. Oppressed. Plundered. For one thousand years. Colonized and then broken apart.

It just made so much sense to get these nuclear weapons. At the time I was not even sure what ‘nuclear’ meant, but I did understand it was a kind of “super weapon”, that it would make India invincible for all of history to come. And that all other nations of the world were really angry and jealous that we had successfully built this ultimate weapon.

So these three men in this picture: Atalji, Dr Kalam and George Fernandes, felt like heroes. More like superheroes who were defending us against the world. An Indian version of the Justice League. All three men have passed away. But the strong nation they built endures.

The Vajpayee era was the transition, the period that brought India from darkness to the light. India was still coming to terms with the ashes of Nehruvian socialism. India was still coming to terms with the reforms of 1991, rubbing its eyes and trying to understand the bold new world. We had been asleep for forty years. The world had passed us by.

We did not know if the new world even had a place for us. Whether we would survive.

It was during the Vajpayee era that India realized we could win. That the bold new world could be ours. Words like “economic growth” and GDP entered the Indian political lexicon. Today we see BJP and Congress sparring over who has delivered better GDP growth. This would have been unthinkable before the Vajpayee years. At the time, GDP growth was almost a dirty word. Politicians spoke in whispers about growing the GDP,  worried that it could get them tagged as “anti-poor”! This was the upside down, absurd Nehruvian superstition under which the Indian masses toiled.

Vajpayee took the bull by the horns. In 2004, he paid the price for a nation that still, by and large, did not trust economic growth. But he transformed the nation forever.

Ultimately, individuals don’t matter. Only the nation does.

There is another unforgettable image of George Fernandes that comes to mind. It is of an enraged George Fernandes making sure that Sonia Gandhi’s photograph was pulled down from the Constitution Club where it had been placed beside Dr Bhimrao Ramji Ambedkar and Dr Rajendra Prasad.

Mujhe lagta hai kisi ghulam ke aulaad ne ye kaam kiya hai (I think someone with a slave mentality must have done this)” he said of the person who had placed the photograph there, before adding, “Desh kya in logon ne khaareed liya aake .. Nehru khandaan (Have these Nehru dynasts bought the country?)

Spoken with the same defiant spirit with which he raised his shackled hand in protest against Indira Gandhi all those years ago. With the clear conscience of a man who knows that his moral compass cannot be hijacked by hypocrisy.

George Fernandes was slandered endlessly by slimy media organizations and sleazy sting operations and during the coffin scam. But his truth endured.

George Fernandes has now passed into history. Om Shanti.

But the resurgent India that took shape during the Vajpayee years will keep going from strength to strength. Even if the heroes of that era are no more. Observe that the period from 1991 to 2004 was the period when the Nehru Dynasty was least relevant in Indian politics. Observe that this is the period when India renewed its march towards greatness.

If there is one regret that I feel, it is that the lion of India’s reforms did not get the farewell he deserved. They say that the Government of India could not even provide flowers and carpets when P V Narasimha Rao passed away in December 2004. His body was shunted to Hyderabad, denied a funeral in Delhi. Which is perhaps okay, because just Delhi isn’t India. We the people. We are India. And the heroes of the 1991-2004 era, who revived our great nation, will be fondly remembered forever. Jai Hind.

‘PUBG wala hai kya’: PM Modi leaves audience in splits with his response to a mother talking about son’s gaming addiction

On Tuesday, Prime Minister Narendra Modi, interacting at the “Pariksha Pe Charcha” with nearly 2,000 students from high school to college managed to break the audience into laughter after a mother asked him a question regarding online gaming.

During the interaction, a concerned mother complained to the Prime Minister that her son was avoiding studies and addicted to online games. To her question, PM Modi replied: “PUBG-wala hai kya? (is he a PUBG gamer?)” which resulted in a loud burst of laughter from the audience present.


However, the Prime Minister on a serious note said the issue is both a problem and a solution while adding that it was not good to dissuade children from technology. “If we want our kids to turn away from technology, then they will fall behind,” said PM Modi.

“Explore ways in which you encourage your children towards accepting and understanding technology. But remember, technology should be used to expand our horizons, not to let it shrink us in our life. It should not be allowed to narrow us down, as that would be very harmful to us,” advised PM Modi.

“Like everything else, technology too comes with its positives and negatives. As parents, we must guide our children to get the most from technology. Encourage their inquisitiveness on learning about various apps, like how to build something, or cook something,” said Prime Minister while interacting with students at Talkatora stadium in New Delhi.

PM Modi said that technology should lead to the expansion of the mind and as a means to innovate and urged the parents to try and make efforts so that children would hopefully move from “PlayStation to the playground”.

It is rather interesting to know that Prime Minister Modi despite his hectic work schedule managed to be aware of such micro issues like online gaming PUBG, which has taken the Internet by storm. PUBG, which is an online multiplayer game has become a huge online trend among the millennials rising concerns among parents for its addictive nature.

Reportedly, PUBG Mobile has been banned in schools recently in the state of Gujarat. The game was launched in December 2017 and has since acquired a massive fan base in India and worldwide.
