Reportedly, Mohammad Hasan, a Quarsi resident claimed to have adopted a three-year-old Hindu girl from a brick kiln in Gujarat’s Ahmedabad where he used to work roughly eight years ago.
Bombay High Court said, "The object of POCSO act is certainly not to punish minors in a romantic or consensual relationship and brand them as criminals."
The victim’s mother got to know about the crime after the girl said that she is having pain in her private parts and refused to get into the school van.
The complaint under POCSO was made by the child's parents on November 30, 2017, alleging that their daughter was led into the washroom by two men—one of whom was known to the children as "Chocolate Kaku"—and then sexually assaulted.
Premiliary investigation revealed that the child could not sleep the whole night. She was not given food and was forced to eat leftovers from the dustbin. Her mouth was completely swollen, and her whole body was covered with injury marks.
Maulana Zeeshan asked the victim to fetch some water. When the girl took water to the accused, Zeeshan locked the minor girl in a room in the madrasa and raped her.
