When the victim's parents questioned her, the girl said two persons, Sappi and Subhan (age not verified) had raped her and her sister for more than 18 months. A medical examination was done on her sister and she was also found pregnant.
The family alleged that local leaders of the Trinamool Congress (TMC) threatened them and asked them to remain silent on the issue and not speak about the matter. TMC has denied involvement.
According to police, the 17-year-old girl eloped from Ajmer with her minor boyfriend on Saturday, 15th of July. After reaching the Jodhpur bus stand on Saturday night, they searched for a place to stay nearby.
Based on a complaint by the victim's father, the Wankaner police registered a case against Siraj Munna Bukhari under sections of the POCSO Act and initiated legal proceedings.
Bombay High Court said, "The object of POCSO act is certainly not to punish minors in a romantic or consensual relationship and brand them as criminals."
The accused person is said to be the driver of a school van and he has been charged u/s 376 of IPC and section 6 of POCSO Act for assaulting a 6-year-old school going girl.
