The Court noted that SHO Ms. Manjeet Kaur along with ASI Sartaj Singh were present in the Court and offered their unconditional apology for the faux pas that occurred in the case due to the mistaken identity of the petitioner.
Mamman Khan said in his petition that the state government, having failed to contain the violence, is now trying to shift responsibility onto its political rivals by unjustly involving him in the case.
The court said, "It is a sorry state of affairs that the police are trying their best to shield the real culprits, at whose instance the illegal mining operations were being carried out."
The affidavit stated that a show cause notice was issued on February 25, 2021, and a personal hearing was also provided on March 3, 2021. However, it was stated that the encroachers did not submit their written reply or show up for the hearing.
The petitioner argued in the court that he had already served a custodial sentence exceeding the two-year punishment imposed on him by the Supreme Court, during the pendency of his appeal, totalling two years and five months.
