The Union Minister's remarks came days after the Supreme Court ruled that states have the power to sub-classify Scheduled Castes (SCs) and Scheduled Tribes (STs). The top court had also observed that states can evolve a policy for identifying the creamy layer, even from the SCs and STs to exclude them from the benefit of affirmative action.
The proposed legislation for private sector reservations would have a chilling effect on meritocracy, ease of doing business, and investment opportunities.
Opposing the religion-based reservations, PM Modi said that the Opposition (INDIA bloc) can perform "mujra" (dance) before their vote bank if they want, but he will not let them snatch away the reservation benefits of the SC/ST/OBC communities guaranteed by the Constitution of India.

According to the NCBC, categorising Muslims as a OBC violates social justice principles, particularly for marginalised Muslim castes and groups that have been categorised as socially and educationally backward.
“A person from the SC/ST community, after getting into central services like IAS and IPS, gets access to the best of facilities. Yet, his children and their children continue to get the benefits of reservation. Should this continue?" Justice Gavai asked.
