Responding to the Centre's contention that same-sex marriage was an urban elitist concept, CJI Chandrachud said there is no data to show it.

Centre apprised the SC that the Union of India, has issued a letter dated April 18 2023 to all States inviting comments and views on the seminal issue raised in the present batch of petitions. 

"It's not the question of what your genitals are. It's far more complex, that's the point," CJI Chandrachud noted.

In their application, the DCPCR stressed that adolescents who identify as homosexual may have negative psychological complexes, low self-esteem, and other mental health problems if they do not have the same legal protections as their heterosexual counterparts.

Jamiat Ulema-e-Hind, via advocate HR Shamshad, submitted an intervention application in the Supreme Court to oppose pleas seeking recognition of same-sex marriages.
